Uber Accidents

At Wind Law, LLC, our Tappahannock &  Richmond Uber accident lawyer, Ryan E. Wind, knows for many of us, taking an Uber when getting around many areas in Virginia is just second nature. The popular ride-sharing service offers convenience and allows us to enjoy a night out without having to worry about where we are going to park, or how we are going to get home safely. However, with this convenience can also come complications, especially in the event of an accident.

The reality is, an Uber driver can get into an auto collision just as easily as any other driver. But what does that mean for the injured passengers? Ryan is licensed to practice law in all courts throughout the Commonwealth of Virginia, including the U.S. District Courts for the Eastern and Western Districts of Virginia. Who is Liable for Virginia Uber Accidents, Injuries, and Fatalities?

A question our office commonly gets is, “Does Uber have to pay if I’m injured in an accident caused by one of its drivers?” The answer depends on the working status of the driver when the accident occurs. Most Uber drivers are considered independent contractors rather than employees of the company. That said, Uber still maintains its own liability insurance coverage.

Uber driver requirements

Virginia Uber driver requirements include:

  • Meet the minimum age to drive in their city.
  • Have at least one year of licensed driving experience in the US (three years if the driver is under 25 years old.
  • Have a valid in-state license.
  • Proof of residency in your city, state, or province.
  • Proof of vehicle insurance.

Where and when the driver’s personal insurance coverage, or Uber’s policy applies depends on a few things:

  • Did the driver have their Uber app activated? If a driver is available and waiting to accept a ride, Uber provides contingent liability coverage of up to $100,000 for personal injuries and $25,000 in property damage. This coverage would apply if, for instance, a driver accidentally hit a pedestrian or another vehicle while waiting to accept a ride.
  • Is there an actual passenger in the Uber vehicle? If you are injured while actually riding in an Uber–or someone else is hurt during an active ride–then Uber’s insurance provides up to $1 million in third-party liability coverage, as well as $1 million in uninsured/underinsured motorist coverage.
  • Was the driver “off the clock”? If someone who regularly drives for Uber does not have their app activated and is not accepting rides, then that driver’s personal car insurance policy would be liable for any accident.

Of course, just because you are injured in an accident while riding in an Uber, that does not necessarily mean your Uber driver was at fault. The accident may be the result of another driver’s negligence. In Virginia, the at-fault driver is responsible for such injuries. But Uber’s uninsured/underinsured insurance coverage might still come into play if the negligent driver lacks sufficient insurance to pay for your damages.

Our Tappahannock & Richmond Uber accident lawyer can help you sift through the details of your crash, so you understand exactly who was responsible for your injuries or the loss of your loved one. We will then provide the skilled legal representation you need to pursue the negligent party’s insurance company for your full financial recovery.

  • Diminished earning capacity.
  • Scarring and disfigurement, including burns, amputations, or dismemberment.
  • Pain and suffering caused by physical discomfort, inconvenience, and emotional distress.

Why Do I Need a Virginia Uber Accident Attorney?

Like all vehicle accidents that may involve more than one insured party, the financial recovery process becomes more complex, as the driver, Uber, or another third party’s insurance provider will begin pointing fingers at one another.

With the sole goal of protecting their bottom lines, each party’s insurance representatives will insist that you — the injured party — prove their policyholder was liable. Unfortunately, this is true even if you were riding as a passenger when the collision occurred and is difficult to accomplish on your own.
