If you were hit by a city vehicle, whether it was a police car, bus, fire engine, or even a garbage truck, your case is not like a typical car accident. The rules are different, the timeline is tighter, and if you wait too long, your chance of recovering compensation could disappear before you even get started.
Real Cases Where We Acted Fast
At Wind Injury Law, we have helped clients in some truly heartbreaking situations. One case involved a family whose son was killed when a police officer sped through a red light. In another, we represented a man who suffered catastrophic injuries when a garbage truck turned directly into his vehicle. We have also stood beside clients who were hurt by a reckless ambulance driver.
In all these city vehicle accident cases, our clients did nothing wrong. But the moment we realized a government or city vehicle was involved, we had to pivot quickly. Everything about how we handled the case changed from that moment forward.
Dealing With the City Means a Different Process
Once a city or government entity is involved, the process becomes much more complex. You must notify the city in writing right away, which is very different from how you deal with a typical insurance company. The city has its own legal department, and their first move is often to deny responsibility or claim legal immunity. That forces us to investigate whether the driver of the city vehicle was actually acting within the scope of their job and whether they followed the correct procedures.
In some situations, if the city vehicle driver was performing an official government function at the time of the crash, we must prove what the law calls gross negligence. For example, if a fire engine was responding to a fire with its lights and sirens on, the city is not responsible unless the driver’s behavior went far beyond simple carelessness. But if that same fire engine was just driving around town like any other vehicle, then we only need to prove regular negligence.
Why City Vehicle Accident Cases Are Tougher
Cities and government agencies use many of the same tactics as big insurance companies to try to avoid paying claims. They look for loopholes, stall, and argue over liability. But because we know this playbook and because we act fast, we have been able to protect our clients’ rights. That includes dealing directly with the city’s claims department, building strong cases, and pushing every step of the way to get meaningful results.
In the end, we have secured significant settlements for clients in the city vehicle accident situations, but only because we understood the legal process and moved quickly.
Most People Do not Know the Rules Until It is Too Late
Suing a city is different from suing another driver. Cities often have legal protections called immunity. That means they can only be sued under certain conditions, and even then, you must follow strict procedures.
One of the most important steps is filing a notice of claim. This is not a lawsuit, but a formal notice telling the city that you intend to file one. The deadline to send that notice is much shorter than the deadline to file a regular lawsuit. In some cases, you only have a few months to do it. If you miss that window, it does not matter how strong your case is. You lose your right to sue.
Extra Red Tape and Legal Delays
Cases involving a city vehicle tend to move more slowly and require more documentation. The government process adds extra layers of review and paperwork, and even one small mistake in how things are filed can delay or ruin your case entirely.
If you’ve been hit by a city vehicle or injured because of something the city failed to maintain, you need to speak with an attorney right away. Do not assume it is just like any other accident. It is not.
